Our Probate & Trust Administration Services Include:
Probate Court Filings — We prepare and file all required petitions, inventories, accountings, and other documents with the Vermont Probate Division.
Executor & Administrator Representation — We advise and represent personal representatives appointed to administer a decedent's estate, from opening the estate to final distribution.
Trustee Counsel — We advise successor trustees on their duties, responsibilities, and the proper administration of trust assets under the terms of the trust instrument and Vermont law.
Beneficiary Representation — We represent beneficiaries in ensuring that estates and trusts are administered properly and that distributions are made in accordance with the governing documents.
Intestate Administration — When a person dies without a will, Vermont's intestate succession laws govern the distribution of their assets. We guide families through the process when no estate plan is in place.
Small Estate Administration — Vermont provides simplified procedures for small estates. We help families determine eligibility and navigate the streamlined process.
Estate Tax Guidance — We advise clients on Vermont and federal estate tax obligations and coordinate with your CPA or financial advisor as needed.
What Is Probate?
Probate is the court-supervised process by which a deceased person's assets are inventoried, debts are paid, and remaining assets are distributed to beneficiaries. In Vermont, probate is handled through the Probate Division of the Superior Court. The process can take months to years depending on the size and complexity of the estate. A properly drafted revocable living trust can allow your estate to bypass probate entirely — which is why proactive estate planning is so valuable.
